Agency explanation

Debarment was proposed because a USDA Office of Inspector General (OIG) investigation revealed that CAPELLAN, DIAZ, and GUILIANO engaged in a scheme whereby they purchased produce on credit from growers for resale but failed to remit payment. When growers and/or shipping companies pursued payment through email and/or phone and text messages, CAPELLAN, DIAZ, and GUILIANO ceased all communication. After a certain amount of time and claims made against a certain company name, CAPELLAN, DIAZ, and GUILIANO would “close” that company and open a new company under a new and “clean” name. As a result of the scheme, victims lost more than $973,000 in unpaid produce and shipping orders. For further information contact the U.S. Department of Agriculture Agency Exclusions POC.

What is an exclusion?

An exclusion is a federal restriction on a business or individual participating in certain government contracts or assistance programs. Records can include suspensions, debarments and other restrictions.

Use these records to check potential vendors and partners. Restrictions vary: review the status, dates and scope in SAM.gov, and confirm any potential match with the issuing agency. An inactive record does not by itself mean a current restriction.
