Agency explanation

Pursuant to a Settlement Agreement entered into between the United States and Richard Gauger, Mr. Gauger agreed to permanent voluntary exclusion under 2 C.F.R. Part 180 from obtaining funding for any new conservation easements from USDA-NRCS Farm and Ranch Lands Protection Program (FRPP), or from any other Federal conservation easement program. The Settlement Agreement was pursuant to notification to Mr. Gauger that the United States had causes of actions and administrative claims against Mr. Gauger under the False Claims Act, 31 U.S.C. §§ 3729-3733, at common law, under administrative regulations, and other potential remedies, arising from Mr. Gauger's participation in, or responsibility for, submitting false statements to USDA-NRCS as part of obtaining FRPP conservation easements.

Restriction and scope

Applies across federal procurement and nonprocurement programs, subject to the issuing agency’s record and applicable exceptions.

What is an exclusion?

An exclusion is a federal restriction on a business or individual participating in certain government contracts or assistance programs. Records can include suspensions, debarments and other restrictions.

Use these records to check potential vendors and partners. Restrictions vary: review the status, dates and scope in SAM.gov, and confirm any potential match with the issuing agency. An inactive record does not by itself mean a current restriction.
