Debarment was proposed because on June 22, 2023, Channing Strother, Chief Administrative Law Judge, U. S. Department of Agriculture, issued a decision that ordered COLBERT to cease and desist from engaging in operations subject to the Packers and Stockyards Act (the Act) without an adequate bond or bond equivalent.
On June 19, 2024, AMS’ Packers and Stockyards Division (PSD) issued a Notice of Default to COLBERT for not filing the required annual report for dealers for 2023. The default notice informed COLBERT that if they failed to file the required annual report within 30 days, a complaint could be filed against them in the United States District Court charging them with violations of the Act and seeking civil penalties.
In January 2025, the Compliance, Audit, Risk and Safety Division consulted with PSD to determine the status of COLBERT’s operation. PSD confirmed that COLBERT has continued to operate as a dealer without obtaining the required bond or filing the required report. PSD also stated that COLBERT had not filed the required annual report since 2019.
The Respondent’s ongoing failure to maintain the required bond and report required information to PSD in violation of the Act establishes causes for their debarment governmentwide under 2 C.F.R. § 180.800(d), as this misconduct constitutes a cause of so serious or compelling a nature as to affect their present responsibility. Restriction and scope
Applies across federal procurement and nonprocurement programs, subject to the issuing agency’s record and applicable exceptions.
What is an exclusion?
An exclusion is a federal restriction on a business or individual participating in certain government contracts or assistance programs. Records can include suspensions, debarments and other restrictions.
Use these records to check potential vendors and partners. Restrictions vary: review the status, dates and scope in SAM.gov, and confirm any potential match with the issuing agency. An inactive record does not by itself mean a current restriction.
