Agency explanation

This Notice is based on the Plea Agreement (the “Plea Agreement”) entered into relating to the criminal case in the Southern District of Mississippi’s Criminal Division (Criminal No. 2-13cr-00022-KS-MTP) that was filed on September 17, 2014. Section 9 of the Plea Agreement provides that “[t]he Defendant agrees that he and any of his companies or affiliated companies will be permanently suspended, excluded and debarred from any current and future government contracts, either as a prime contractor or sub-contractor…” the agreement is applicable to the individual and all affiliates causing lifetime debarment, constitutes a “voluntary exclusion” under 2 C.F.R. §§ 180.635 and 180.640. For further information contact the U.S. Department of Agriculture Agency Exclusions POC.

Restriction and scope

Applies across federal procurement and nonprocurement programs, subject to the issuing agency’s record and applicable exceptions.

What is an exclusion?

An exclusion is a federal restriction on a business or individual participating in certain government contracts or assistance programs. Records can include suspensions, debarments and other restrictions.

Use these records to check potential vendors and partners. Restrictions vary: review the status, dates and scope in SAM.gov, and confirm any potential match with the issuing agency. An inactive record does not by itself mean a current restriction.
