Description

This presolicitation notice is being posted to satisfy the requirement of Defense Federal Acquisition Regulation Supplement (DFARS) Procedures, Guidance and Information (PGI) 206.302-1. Naval Air Systems Command (NAVAIR), Program Office, PMA-201, Patuxent River, Maryland, intends to award a sole source modification of Indefinite Delivery, Indefinite Quantity (IDIQ) contract N0001924D0104 to Northrop Grumman Systems Corporation - Defense Systems (NGSC-DS), Rocket Center West Virginia, to increase the existing ceiling for additional domestic FMU-139D/B Fuze and accessory kits, along with the associated technical data. This notice is published for informational purposes only. (THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS). This requirement is anticipated to be procured sole source to NGSC-DS under the statutory authority of 10 U.S.C. 2304(c)(l), as implemented by Federal Acquisition Regulation (FAR) 6.103-1, only one responsible source and no other supplies or services will satisfy agency requirements. This modification is anticipated to be awarded no later than 2nd Quarter of Fiscal Year 2027. NGSC-DS is the only company that has the requisite knowledge, production tooling, facilities and technical data necessary to meet this requirement within the necessary schedule as NGSC-DS is the only vendor with a qualified FMU-139D/B Fuze. In accordance with FAR 6.103-1(c)(2)(ii), award to any other source would result in unacceptable schedule delay in fulfilling the agency's requirement. This contract was awarded 01 September 2024, under authority 10 USC 2304(c)(l), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. This contract consists of three one-year ordering periods and will expire on 31 August 2027. This modification will increase the ceiling of contract N0001924D0104, in the amount of $97M, in order to cover the final ordering period of performance which expires 17 June 2028. The potential items being procured in the final ordering period are the FMU-139D/B Fuze; FMU-139D(D-1)/B Fuze Assembly, Inert; FMU 139D(D-2)/B Inert Load Crew Training Fuze System; FMU 139D(D-5}/B Inert Cut Away Fuze; FZU-48A/B Bomb Initiator; Power Cable; Closure Ring; and associated Technical Data. This action would allow the United States Navy (USN) and United States Air Force (USAF) to meet their domestic requirements, as well as a small portion of their Foreign Military Sale obligations, within the final ordering period. This action is necessary because unforeseen world events caused an increase in demand for FMU-139D/B fuzes and accessories within the Foreign Military Sale arena for ordering periods 1 and 2 associated with the original IDIQ Contract. If the contract ceiling is not increased to accommodate the anticipated requirements of this contract, the United States Government will not be able to obtain their domestic requirements for the FMU-139D/B, which would also result in a significant production gap. The justification and approval for this ceiling increase has been attached to this notice. IMPORTANT ADDITIONAL INFORMATION FOR INTERESTED PARTIES: This notice of intent is not a request for competitive proposals. However, responsible, interested parties may identify their interest and capability by responding to this notice. The Government will consider all information received prior to the closing date of this notice. A determination by the Government not to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government. There are no commitments by the Government to issue any solicitations, make an award or awards, or to be responsible for any monies expended by any interested parties before award of a contract for the efforts mentioned above.
