These Terms of Service (“Terms”) govern access to and use of GovGazette websites, accounts, and paid subscription features. By creating an account or using the service, you agree to these Terms.

These Terms are a product baseline for a small software business — not a substitute for counsel in every jurisdiction.

1. The service

GovGazette provides a readable index of U.S. federal contract opportunities derived from official public sources, plus optional workflow tools (saved searches, digests, triage, Fit Briefs, exports) for authenticated users. Free browsing of public pages does not require a paid plan.

A related x402 agent API may be offered on a separate host with machine-facing pricing. Agent API use is subject to that host’s documentation and payment rails and is not a marketplace “credits” wrapper for the human subscription product.

2. Not legal advice; no award guarantees

Content and tools are for intelligence and triage only. We do not provide legal, tax, or procurement counsel. We do not guarantee eligibility, awards, past performance outcomes, or that any opportunity will remain open. Always verify requirements on official SAM.gov notices and consult qualified advisors for your situation.

3. Accounts

  • You must provide accurate registration information
  • You are responsible for activity under your credentials
  • You must be able to form a binding contract (e.g. age of majority where you live)

4. Subscriptions & billing

Paid plans (e.g. Pro, Fit Briefs, Team) are billed via Stripe according to the plan you select. Fees are generally non-refundable except where required by law or explicitly stated. You can cancel to stop future renewals; access continues through the paid period unless otherwise stated.

We may change prices with notice for subsequent billing periods. Feature entitlements are defined in-product and on the pricing page and may evolve.

5. Acceptable use

You agree not to:

  • Break the law or infringe others’ rights
  • Scrape or bulk-export the service in a way that degrades service or violates these Terms (public pages may still be crawled by ordinary search engines we welcome)
  • Attempt unauthorized access or disrupt infrastructure
  • Misrepresent affiliation with the U.S. government, SAM.gov, GSA, SBA, or any agency
  • Use outputs to claim false certifications, fabricated incumbents, or guaranteed win rates

6. Intellectual property

GovGazette branding, software, and original content are owned by us or our licensors. Official government data remains subject to its public source terms; we do not claim ownership of raw SAM.gov notices.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation or perfect data completeness.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF YOU HAVE NOT PAID).

9. Indemnity

You will defend and indemnify us against claims arising from your misuse of the service, your content, or your violation of these Terms or law.

10. Termination

We may suspend or terminate access for violations of these Terms or risk to the service. You may stop using the service and cancel paid plans at any time.

11. Governing law

These Terms are governed by the laws of the State of Texas, USA, excluding conflict-of-law rules, unless mandatory local law says otherwise. Venue for disputes lies in state or federal courts located in Texas, subject to applicable consumer protections.

12. Changes

We may update these Terms. Continued use after the updated date constitutes acceptance of the revised Terms for subsequent use.
