Description

NOTICE OF INTENT TO AWARD SOLE SOURCE PROCUREMENT: The U.S. Army Corps of Engineers, Albuquerque District (SPA) intends to award a sole-source, Firm-Fixed Price (FFP) Purchase Order to Caracal Enterprises, LLC dba VenTek International (CAGE Code: 3YDH6), located at 1260 Holm Rd STE A, Petaluma, CA 94954. This is a non-personal services purchase order to provide fee machine subscription services for eight 8 automated fee machines (AFM) as part of USACE Lakes and Dams and will be managed and maintained by Operations Division. This action will be conducted under the authority of Revolutionary FAR Overhaul (RFO) 12.102(a) soliciting from a single source. Although the Government now owns the previously mentioned AFMs, which includes the first year of digital/maintenance services, Ventek International owns the software rights that performs collection, reporting, and transfer of park user fees to the U.S. Treasury on the Governments' behalf. Therefore, no other company can perform these subscription services as they are proprietary. A determination by the Government not to compete this proposed requirement is based upon the fact that Ventek Internation, is the current provider, of the current operation of eight (8) fee machines with complete software management system for revenue collection networks that provide real-time machine statistics, passive monitoring, remote machine configuration and reporting. USACE has invested significant time training personnel. Services are required for the fee machines to maintain their functionality; without additional services the machines would be rendered non-operational. Subsequently, this product continuity is critical to the success of USACE missions; USACE would be unable to commission another company and be consistent and timely. These machines were procured in 2021 and additional machines in 2024 and have become a key part of the USACE Lakes and Dams, used to provide complete software A complete software management system for revenue collection networks that provides real-time machine statistics, passive monitoring, remote machine configuration and reporting. All transaction details are automatically uploaded to USACE�s individual database via a cloud-based network and is instantly available for viewing or through a number of standard reports from any internet connected device. THIS IS NOT A FORMAL SOLICITATION. This Notice of Intent is not a request for competitive quotations. However, all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. All submissions will be evaluated for the sole purpose of determining whether competitive opportunities exist. Any response to this notice must show clear and convincing evidence that competition would be advantageous to the Government. A determination by the Government not to compete the contract based upon responses to this notice is solely within the discretion of the Government. All responses received within 15 days will be considered. Late submissions will not be considered. Detailed responses to this notice shall be submitted to the following email addresses no later than 2:00 PM (Mountain Daylight Time), July 22, 2026; glenda.d.kohlieber@usace.army.mil. Telephone responses will not be accepted. If no submissions are received, the government will proceed with the intended noncompetitive action. An informational copy of the noncompetitive solicitation will be available IAW FAR 5.102(a) on or after (date), but competitive (quotations/bids/proposals) will not be considered. To obtain a copy of the of the noncompetitive solicitation please email Glenda Kohlieber at glenda.d.kohlieber@usace.army.mil The US Army Corps of Engineers, Albuquerque District, will not reimburse for any costs connected with supplying sufficient detail to demonstrate the ability to comply with the requirement listed. In order to be eligible for award of a Government contract, a firm must be actively registered in the System for Award Management (SAM), have no active exclusions, and complete the FAR and DFARS representations and certifications. Firms must register on a one-time basis, and annually confirm accuracy and completeness of registration information.
