Description

Notice of Intent to Limit Competition The U.S. Army Corps of Engineers, Sacramento District is issuing this announcement for the acquisition of Giant Garter Snake (GGS) Mitigation Bank Credits. The U.S. Army Corps of Engineers, Sacramento District, intends to negotiate on a limited source basis under the authority of FAR 12.102(b), Simplified Procedures for Certain Commercial Products and Commercial Services. A justification for the purchase of 16.08 GGS habitat mitigation credits has been prepared in support of this acquisition to offset the effects of the Lower San Joaquin River Project (PL 84-99), requirement Rehabilitation Inspection Program 2017 Flood Event. The U.S. Fish and Wildlife Service (USFWS) requires that credits must be purchased within the same general area (bank service area) of the original construction impacts (the Sacramento Basin). This limits the choices and availability of credits. Each mitigation bank has a select service area defined by the USFWS, and credits must be purchased from a bank whose service area includes the location affected by construction. Market research indicates that only a limited number of approved mitigation banks possess GGS credits within the mandated service area. This notice is not a request for competitive proposals from the open market. However, any firm that believes it is capable of providing USFWS-approved GGS credits within the mandated Sacramento Basin service area may submit a capability statement. All responses received within 15 calendar days of the date of publication of this notice will be considered by the Government. A determination by the Government not to compete this proposed action based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Responses should include the firm's Unique Entity Identifier (UEI) and Tax Identification Number (TIN). Firms should identify business size in accordance with the size standard for NAICS Code 813312, Environment, Conservation, and Wildlife Organizations ($17 million).
