Description
FOR INFORMATIONAL PURPOSES ONLY PTAG Part 6.1.1 Synopsis � Intent to Sole Source The United States Patent and Trademark Office (USPTO), Office of Policy and International Affairs (OPIA), and the Global Intellectual Property Academy (GIPA) has a brand name justification requirement for a Service Level Agreement (SLA) for the already installed and existing Televic Mic System used for Simultaneous Interpretation in the GIPA Academy. This requirement will ensure secure, available, and fully operational audio/conference capability for scheduled and ad-hoc meetings, including interpretation functionality where applicable. The requirement shall provide maintenance, troubleshooting, repair of hardware, remote (via phone or email) diagnostics, remediation where feasible, onsite support for incidents that cannot be resolved remotely, spare parts management, and replacement for covered components which are proprietary from Televic. The Vendor shall provide all labor, supervision, materials, tools, test equipment, transportation, and Original Equipment Manufacturer-authorized services necessary to maintain and support the Televic Confide system. For this procurement, the USPTO is exempt from the Competition in Contracting Act (CICA) as the subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG) and the Patent and Trademark Office Efficiency Act 35 U.S.C. 2(b)(4)(A). In accordance with PTAG 6.1.1, the USPTO conducted market research which included posting a �for information only� intent to sole source to SAM.gov. The results indicate that only Televic Conference US Corporation 7008 Virginia Manor Road, Beltsville, MD 20708 can meet this brand name USPTO requirement. Televic Conference US Corporation is uniquely qualified to perform this requirement since the system installed is Televic. Engaging another vendor would require substantial increased costs, and potential risk to performance due to the lack of access to the proprietary items. Televic Conference US Corporation is the only brand and responsible source capable of fulfilling this requirement within the required timeframe and without incurring unnecessary cost or risk to the proprietary components of the Government. Consequently, per PTAG 6.1.1 (d) the USPTO intends to negotiate and award a firm fixed price contract with Televic Conference US Corporation. This requirement utilizes NAICS code 334310 and has a period of performance of base and two option years. This notice of intent is not a request for competitive proposals nor will a solicitation be issued to the public.
