Description

This is a notification that the United States Marshals Service (USMS) Asset Forfeiture Division (AFD) intends to award a sole source, Firm-Fixed Price contract under statutory authority 41 USC 3304(a)(1) as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy the Agency Requirements. The current contractor, K2K9 Solutions LLC. located at 369 Currie Rd. Jackson Spring, NC 27281, is providing services for onsite seizure/evidentiary support, transportation, daily care, veterinary treatment, food, kenneling, expert witness services as needed, and disposal services for canines involved in illegal fighting operations. This notice is to inform industry contractors of the Government�s intent to execute a sole source award to provide uninterrupted, high-quality continuity of support maintenance for the Agency's seized and forfeited assets. This procurement is being conducted using commercial item procedures pursuant to Federal Acquisition Regulation (FAR) Part 12 and FAR Part 13, specifically FAR 13.106-1(b)(1), allowing the Contracting Officer to solicit from one source. The North American Industry Classification System (NAICS) for this requirement is 812910 Pet Care (except veterinary) Services with a size standard of $9 Million. This notice of proposed contract action is required by FAR 5.201. This action will result in a new contract which is necessary to allow for continuity of critical contractor services until a new contract is awarded in 2nd QTR FY26. The USMS will solicit and negotiate directly with K2K9 Solutions LLC. and no solicitation will be issued. This notice of intent is not a request for competitive proposals or quotations and no solicitation is available. This synopsis is to give notice of the Government�s intent to make a sole source award; however, if an interested party believes they can meet the above requirement, it may submit a statement of capabilities. The statement of capabilities must be submitted in writing and must contain material in sufficient detail to allow the Government to determine if the party can perform the requirement. Any information received as a result of this notice will be considered solely for enhancing competition in a future competitive procurement. Responses to this notice, if any, must show clear and convincing evidence that competition would be advantageous to the government. A determination not to compete this proposed contract action is solely within the discretion of the Government. The Government will not reimburse for any costs connected with providing the capability information. All responses must be received no later than 10/20/2025 and should be submitted to Christopher Ottie, Contracting Officer, via email at Christopher.ottie@usdoj.gov.
