Description

NOTICE OF INTENT TO SOLE SOURCE The U.S. Army Corps of Engineers (USACE), Jacksonville District established a contract with The University of Central Florida (CAGE 9H673), of Orlando, FL, on a sole-source basis IAW FAR 13.106-l(b)(l), to survey nesting, threatened and endangered (T&E) sea turtle species at the project footprint of the Brevard County South-Reach project. Due to an "act of God" incident occurring to the dredge assigned to the Brevard County South-Reach project, there is a delay in the project implementation schedule and additional monitoring is required. The Government intends to modify the existing contract and solicit The University of Central Florida on a sole-source basis under the authority of 10 United States Code 3204(a)(l) as implemented in Federal Acquisition Regulation 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. A sea turtle monitor is required for this effort and must be permitted by the state. Under Florida Statute 379.2431 (1) and Florida Administrative Code Rule 68E-1, the Florida Fish and Wildlife Conservation Commission (FWC) can only issue one permit for sea turtle conservation work if there is a need for that activity. On beaches where FWC has already issued a permit to an individual, organization, or firm to conduct nesting surveys, the FWC does not issue a second permit unless additional activities not being conducted under the standing permit exist. The University of Central Florida is the only Marine Turtle Permit Holder for the Brevard County locations identified in the Performance Work Statement (PWS). As the only Marine Turtle Permit Holder, the University of Central Florida is the only contractor qualified to perform the services in the PWS. Based on the foregoing, the University of Central Florida is determined the only responsible source. This requirement will be solicited using other than full and open competition in accordance with FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. No solicitation will be posted for this requirement. No telephone requests will be honored. The applicable North American Industry Classification System (NAICS) code assigned to this procurement is 541620, Environmental Consulting Services.
