Notice of Intent to Issue a Federal Supply Schedule (FSS) Sole Source Justification The Office of the Director (OOD), the Office of General Counsel (OGC) has a requirement for a commercially available enterprise Software-as-a-Service (SaaS) Freedom of Information Act (FOIA) case management information technology (IT) application system, to negotiate on a FSS sole source justification pursuant General Services Administration Acquisition Regulation (GSAR) Subpart 538.7104-3(b)(1)(ii), with Casepoint LLC., 1101 17th Street NW FL 12, Washington, DC 20036-4704, as the only source identified as capable of meeting the Government�s operational continuity, migration, cybersecurity, interoperability, and mission support requirements without unacceptable disruption or transition risk: Proprietary FOIAXpress migration capability Requirement to preserve existing FOIA metadata, workflow structures, audit histories, and operational continuity without substantial reconstruction activities Operational continuity within the existing FOIA processing environment FedRAMP High operational maturity and DOJ-compatible security requirements Compatibility with existing FOIA workflows and reporting structures Avoidance of substantial redevelopment, retraining, and transition risk This solution is critical to OGC mission operations because it supports ongoing FOIA request processing, statutory response timelines, litigation support activities, records retention requirements, and continuity of FOIA operations. This is a pre-solicitation notice in accordance with RFO 5.101. Casepoint FOIA is a proprietary commercial SaaS platform with native migration capability for the existing FOIAXpress environment currently supporting USMS FOIA operations. Maintenance, hosting, migration support, and operational platform support services are provided directly by Casepoint LLC. This acquisition is being conducted under GSAR 5383.7104-3. There are no set-aside restrictions for this requirement. The intended procurement will be classified under North American Industry Classification System (NAICS) 513210 � Software Publishers with a Small Business Size Standard of $47,000,000 and Product Service Code 7A21 � IT and Telecom � Business Application Software (Perpetual License Software). This notice is not a request for competitive proposals. However, any parties interested in responding to this notice shall submit technical data, including cost, sufficient to determine capability in providing the same service. All capability statements received by closing of this notification of this synopsis will be considered by the Government. A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. These deficiencies were determined material because they would require significant redevelopment activities, operational transition support, cybersecurity reassessment, or interruption to ongoing FOIA operations. Based on the Government�s market research and technical evaluation, Casepoint LLC is currently the only identified source capable of satisfying the Government�s requirements. Submit email capability statements (using PDF, MS Word, Excel attachments) to Mikelle Everett at mikelle.everett@usdoj.gov. Statements are due no later than 5:00 P.M. EST on 24 May 2026. No phone calls will be accepted. The Government will consider all capability statements received but reserves the right to proceed with a FSS sole source award if no viable alternatives are identified.
