Description

This is a Synopsis as required by the Small Business Act (15 U.S.C. 637(e)) and Procurement Policy Act (41 U.S.C. 416)) and fulfills the synopsis and advertising requirements prescribed in Revolutionary FAR Overhaul (RFO) Part 5 � Publicizing Contract Actions. The solicitation will consist of the following two National Stock Numbers (NSNs) with Contractor First Article Test and Production Lot Test quality requirements: NSN: 4240-01-529-8327; Part Number: 71014/12; Clear Assembly Outsert NSN: 4240-01-528-9288; Part Number: 71014/11; Laser Assembly Outsert The approved source for these items is: Avon Protection Systems Incorporated (CAGE � 1LEW5). Only currently approved part numbers/materials are authorized for procurement because the item is a critical application Chemical Biological Radiation and Nuclear (CBRN) Personal Protective Equipment (PPE) item. Adequate data for the evaluation of alternate offers is not available at the procurement agency. The offeror must provide a complete data package including data for the approved and alternate part for evaluation. This item has technical data some or all of which is subject to export-control of either the International Traffic in Arms Regulations (ITAR) or the Export Administration Regulations (EAR) and cannot be exported without prior authorization from either the Department of State or the Department of Commerce. Export includes disclosure of technical data to foreign persons and nationals whether located in the United States or abroad. This requirement applies equally to foreign national employees and U.S. companies and their foreign subsidiaries. DFARS 252.225-7048 is applicable to this data. The Defense Logistics Agency (DLA) limits distribution of export-control technical data to DLA contractors that have an approved US/Canada Joint Certification Program (JCP) certification, have completed the Introduction to Proper Handling of DOD Export-Controlled Technical Data Training and the DLA Export-Controlled Technical Data Questionnaire (both are available at the web address given below), and have been approved by the DLA controlling authority to access the export-controlled data. Instructions for obtaining access to the export-controlled data can be found at: https://www.dla.mil/Logistics-Operations/Enhanced-Validation/. To be eligible for award, offerors and any sources of supply proposed for use are required to have an approved JCP certification and must been approved by the DLA controlling authority to access export-controlled data managed by DLA. DLA will not delay award in order for an offeror or its supplier to apply for and receive approval by the DLA controlling authority to access the export-controlled data. The solicitation issue date will be on or around June 3, 2026, and the closing date will be thirty (30) days thereafter. All responsible sources will be able to submit a quote which will be considered by DLA Troop Support. The acquisition will be accomplished using Other than Full and Open Competition Procedures in accordance with RFO FAR 6.103-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The solicitation will be issued as an Unrestricted, Fixed Price with Economic Price Adjustment (EPA), Indefinite Delivery/Indefinite Quantity (IDIQ) type contract. The contract will include a one (1)-year base period, and four (4) one (1)-year option periods. Delivery terms will be FOB Origin and Inspection and Acceptance will be at Origin. Buy American Act and Berry Amendment clauses apply. RFO FAR Part 12, Acquisition of Commercial Products and Commercial Services and RFO FAR Part 15, Contracting by Negotiation will be utilized. This synopsis should NOT be considered a Request for Proposal (RFP), Request for Quote (RFQ), or an Invitation for Bid (IFB). The Government is in no way obligated to purchase any material as a result of this notice. To be considered for award, interested vendors must be registered in the System for Award Management (SAM). The SAM site may be accessed at https://www.sam.gov. Price will be the only evaluated factor utilized for the proposed acquisition. A copy of the solicitation can be obtained through the DLA Internet Bulletin Board System (DIBBS).
