NOTICE OF INTENT TO AWARD (SOLE SOURCE) Notice of Intent Number: 52000PR260026584 1. Synopsis of the Requirement The Government hereby submits a notice of intent to award a sole-source, firm-fixed-price contract/purchase order to: Proposed Contractor: ORCA3D, LLC Contractor Address: 908 Song Sparrow CT, Arnold, Maryland 21012 Requirement Title: Orca3D Marine CFD Premium Plug-in Total Estimated Value: [Not provided in JOTFOC] It is the belief of the Government that this organization is the sole source to fulfill the need of one responsible source to satisfy the agency's requirement. (See attached justification [JOTFOC]). 2. Regulatory and Statutory Authority This sole-source contracting action is conducted in accordance with Federal Acquisition Regulation (FAR) Class Deviation / Revolutionary FAR Overhaul (RFO) guidelines. Under the RFO, simplified procedures for commercial acquisitions are consolidated under RFO FAR Part 12 [specifically RFO FAR 12.201-1 (Simplified procedures) and RFO FAR 12.102(a) for acquisitions valued at or below the Simplified Acquisition Threshold]. The statutory and regulatory authorities permitting other than full and open competition are: Regulatory Authority: RFO FAR 6.103-1, �Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.� Statutory Authority: 10 USC 3204(a)(1) for Coast Guard. 3. Acquisition Details North American Industry Classification System (NAICS) Code: 513210 SBA Small Business Size Standard: $47,000,000.00 Product Service Code (PSC): 7A21 Requirement Summary: Delivery of the Orca3D Marine CFD Premium plug-in to allow USCG ESD naval architects to do their design and hydrodynamic analysis work directly in Rhino. 4. Submission Instructions to Interested Parties This hereby constitutes a synopsis of the items included in this requirement. This notice is NOT a request for competitive quotes or proposals, and a written solicitation will not be issued. However, responses to this notice demonstrating clear and convincing evidence that competition would be advantageous to the Government, would not be cost or time prohibitive, and would not hinder critical mission objectives will be considered. The determination not to compete this proposed contract action is solely within the discretion of the Government. Information received will be considered solely for the purposes of determining whether to conduct a competitive solicitation for future requirements regarding this program. The Government will not be responsible for any costs incurred by responding to this notice. 5.
